Air Toxics Act

On June 24, 2021 the Air Toxics Act (HB21-1189) relating to additional Public Health Protections in Relation to the Emission of Air Toxics was signed into law.  This bill creates a new program in CDPHE to regulate toxic air contaminants at four covered facilities, along with a community monitoring program, prioritizing disproportionately impacted (DI) communities, to better protect public health.

Key elements of the bill include a required fenceline monitoring program at each of the following four covered facilities:

  1.  Suncor Refinery, Commerce City
  2.  Phillips 66 Pipeline Terminal, Commerce City
  3.  Sinclair Pipeline Terminal, Henderson
  4.  Collins Aerospace (Goodrich Carbon Product), Pueblo

Fenceline Monitoring Plans

The fenceline monitoring program will include a public emergency notification system, and all data will be made available to the public in both English and Spanish.

Community Monitoring

The community monitoring program includes a new state-of-the-art mobile platform called the Colorado Air Toxics (CAT) mobile laboratory, operated by CDPHE. The covered air toxics (hydrogen cyanide, hydrogen sulfide, and benzene) will be measured in communities within a three-mile radius of the covered facilities.

In addition, several ground-based monitoring sites within the sampling regions of the covered facilities will expand the program's monitoring capabilities for the surrounding communities.
