Update: On Oct. 16, 2024, the Air Quality Control Commission adopted updates to Regulation 22, Part A. The rule expands greenhouse emissions reporting requirements for several air pollution sources across the state, including municipal solid waste landfills. More than 30 landfills that did not previously report their greenhouse gas emissions must begin reporting their emissions by March 31, 2025.
Overview
In its October 2024 meeting, the Colorado Air Quality Control Commission approved updates to the state’s greenhouse gas reporting requirements. During the hearing, the commission adopted updates to Regulation 22, Part A.
The updated requirements align Colorado’s greenhouse gas reporting rule with updated federal reporting requirements for greenhouse gas emissions under Title 40 of the Code of Federal Regulations, Part 98.
Changes in federal requirements included as part of this rulemaking are:
- Updates to emission reporting requirements.
- Updates to how emissions are estimated.
- Improvements to how data are confirmed to be accurate.
- Clarifications and corrections to existing subparts in federal requirements.
- Updates to global warming potential values for greenhouse gases.
The updated rule expanded greenhouse gas reporting requirements to several air pollution sources in Colorado, including municipal solid waste landfills. As of October 2024, Colorado has about 50 active municipal solid waste landfills. Regulation 22, Part A, previously required 20 of those landfills to report their greenhouse gas emissions to the division. The updated reporting rule requires all open or active municipal solid waste landfills and closed municipal solid waste landfills with gas collection and control systems to report their emissions. The division estimates more than 30 additional municipal solid waste landfills are now subject to these new reporting requirements. Municipal solid waste landfills mainly receive household waste and do not treat any hazardous materials like biological waste.
Newly-covered municipal solid waste landfills must begin reporting their greenhouse gas emissions starting March 31, 2025. This information will help Colorado better understand greenhouse gas emissions from municipal solid waste landfills and help improve the state’s greenhouse gas inventory.
