Overview
The Colorado Air Quality Control Commission will hold a rulemaking hearing on greenhouse gas reporting requirements in October 2024. During the hearing, the commission will consider updating its existing Regulation 22, Part A.
The CDPHE Air Pollution Control Division’s proposed changes will align Colorado’s greenhouse gas reporting program with updated federal reporting requirements for greenhouse gas emissions under Title 40 of the Code of Federal Regulations, Part 98.
Changes to federal requirements that will be covered as part of this rulemaking are:
- Updates to emission reporting requirements.
- Updates to how emissions are estimated.
- Improvements to how data are confirmed to be accurate.
- Clarifications and corrections to existing subparts in federal requirements.
- Updates to global warming potentials for greenhouse gases.
The division also proposed updates to expand greenhouse gas reporting requirements for municipal solid waste landfills in Colorado. Colorado has 50 active municipal solid waste landfills, and Regulation 22, Part A, requires 20 landfills to report their greenhouse gas emissions to the division. The division estimates an additional 33 municipal solid waste landfills would be subject to these new reporting requirements beyond the landfills that currently report their greenhouse gas emissions to Colorado. Municipal solid waste landfills mainly receive household waste and do not treat any hazardous materials like biological waste.
If the commission approves the rule during its October 2024 meeting, more municipal solid waste landfills would have to report their greenhouse gas emissions starting March 31, 2025. This information would help Colorado better understand greenhouse gas emissions from municipal solid waste landfills and help improve the state’s greenhouse gas inventory.
