HB22-1244: The Public Protections From Toxic Air Contaminants Act

Overview

In June 2022, House Bill 22-1244: The Public Protections From Toxic Air Contaminants Act was signed into state law. This law creates a new program in the CDPHE Air Pollution Control Division to regulate toxic air contaminants.

Key elements of the law include:

  • Creation of an air toxics monitoring program.
  • A requirement for certain sources of air pollution to submit annual toxic air contaminant emission reports.
  • A requirement for the division to conduct a needs assessment for the administration of an air toxics permitting program.

The law also directs the Air Quality Control Commission to:

  • Evaluate gaps in air toxics reporting.
  • Consider revisions to an air toxics reporting program.
  • Identify priority air toxics.
    • For each priority air toxic:
      • Establish health-based standards for General Assembly Approval.
      • Develop emission control regulations.
