Part 10 Rulemaking

Notice of public rulemaking hearing for Radiation Regulations Part 10

We are holding a stakeholder process to engage and notify stakeholders about minor proposed changes to the Colorado Rules and Regulations Pertaining to Radiation Control, Part 10, titled “Radiation Control – Notices, instructions, and reports to workers: inspections”. The primary purpose of the proposed changes is to clarify language for consistency with other radiation control regulations and formatting and to ensure more consistent language with federal rules in 10 CFR Part 19. This rulemaking does not include any substantial changes to the existing requirements.

Stakeholder comment period

A stakeholder comment period for Part 10 was held March 1 through March 31, 2024. No comments were received during the comment period.

A rulemaking hearing is scheduled for June 20, 2024. Refer to the notice of public rulemaking hearing above and the Part 10 rulemaking schedule for further details. 

Part 21 rulemaking: Radon LIRMA program

Notice of public rulemaking hearing for Radiation Regulations Part 21

We are holding a stakeholder process to engage and notify stakeholders about proposed changes to the Colorado Rules and Regulations Pertaining to Radiation Control, Part 21, titled “Colorado Low Income Radon Mitigation Assistance (LIRMA) Program”. The proposed changes will clarify existing language and requirements for consistency with the wording of the Colorado Department of Regulatory Agencies (DORA) licensing requirements for radon measurement and mitigation professionals.

Stakeholder comment period

A stakeholder comment period for Part 21 was held February 5 through March 6, 2024. No comments were received during the comment period.

A rulemaking hearing for Part 21 is scheduled for June 20, 2024. Refer to the public notice of rulemaking hearing above and the Part 21 rulemaking schedule for further details.

Recently amended regulations

The following regulations were amended in 2020-2024:
  • Part 2 and Part 6, effective April 14, 2024
  • Part 3, effective December 15, 2023.
  • Part 4, effective December 15, 2023.
  • Part 7, 17, and 22, effective December 15, 2022.
  • Part 8, Part 5 and Part 2, effective Aug. 14, 2021.
  • Part 21, effective July 15, 2021.
  • Part 16 and Part 19, effective July 15, 2021.

Part 20 (TENORM) and Part 12 Rules

Following an extensive stakeholder process, on November 18, 2020, the Colorado Board of Health adopted the Part 20 TENORM rule along with related changes to the Part 12 regulation. The new rule became effective on January 14, 2021 and is enforceable beginning July 14, 2022.

Although the regulation is complete, with assistance and input from impacted stakeholders, the Radiation program continues to develop guidance to assist in the implementation of the Part 20 TENORM rule.
